So when I use the word discount that is an reduction in the price I would be willing to pay.
Usually due to risk. From the RFQ The State currently contemplates that the Concession Agreement would include a revenue sharing arrangement with the State retaining a percentage of the Lottery's gross receipts in excess of historic gross receipts during a to be determined base year.
Unless you are giving me a decent inflation rate as part of the calc, this can end up a being a big risk in a 75 year deal. A few years of major inflation at the wrong time may mean I pay the state a decent chunk of my revenues forever, I don't really know how you price that in, but you have to price it in.
Next The Concession Agreement will include operating standards related to the operation of the Lottery with which the Concessionaire will be required to comply.
The Concessionaire also will be subject to a regulatory system of control and oversight by the State. This one is going to cost you as well. Unless the regulatory structure is well defined in terms of rights and role this would also require a discount on the price. Then a disclaimer iv any unaudited financial information or other information with respect to the Lottery at any time provided by the State or any of the State's Financial Advisors, legal counsel or other representatives is merely an estimate, assumes the successful implementation of the Lottery's long-term business objectives, is not compiled in accordance with United States generally accepted accounting principles and may not reflect the actual results of the Lottery's operations; and This might be boilerplate, but if I am the one you start moving forward with on this I am going to have my auditor come in and run the numbers.
This is too big of a deal to find an oops with down the road. If I can't do this, that's right a discount. From the highlights. Exclusive Long-Term and Defensible Franchise: As the sole and exclusive lottery in the State, there is no direct competition to the Lottery.
The current legislative framework strictly limits the presence of gaming alternatives. The State anticipates a secure and defensible regulatory and concession framework will be established to maintain the Lottery's unique position as the exclusive lottery gaming in the State and will furthermore provide the concessionaire significant flexibility to operate the business within current law.
It is anticipated that the concession term will be up to 75 years.
First question, how much of the 'significant flexibility to operate the business within current law' is dependent on current law? What are my redresses I get legislated out of business?
We had a state house that voted to close all of the casinos last year. Unlike a road or a bridge a single action of the state legislature and a stroke of the governors pen can put me out of business or add a competitor. What if casino gaming expands significantly? What if you decide to tax me like you tax the casino folks? What if other units of government start to tax lottery sales?
Your exclusive isn't worth much unless I have protections in the contract on it, even if I do it's a discount if I don't it's a huge discount. Because this is a huge risk, I am at the whim of political opinion and will.Of that divine tear and of that human smile is composed the sweetness of the present civilization.
From Switzerland to China the peasants are the real occupiers of the land. The right of conquest alone has, in some countries, deprived men of a right so natural. The general advantage or good of a nation is that of the sovereign, of the magistrate, and of the people, both in peace and war. Is this possession of lands by the peasantry equally conducive to the prosperity of the throne and the people in all periods and circumstances? In order to its being the most beneficial system for the throne, it must be that which produces the most considerable revenue, and the most numerous and powerful army.
We must inquire, therefore, whether this principle or plan tends clearly to increase commerce and population.Steven Sandison confesses to murdering child molester in prison
It is certain that the possessor of an estate will cultivate his own inheritance better than that of another. He labors for himself and his family both with more vigor and pleasure than he would Edition: current; Page: [ 6 ] for a master. The slave, who is in the power of another, has but little inclination for marriage; he often shudders even at the thought of producing slaves like himself.
His industry is damped; his soul is brutalized; and his strength is never exercised in its full energy and elasticity. The possessor of property, on the contrary, desires a wife to share his happiness, and children to assist in his labors. His wife and children constitute his wealth. The estate of such a cultivator, under the hands of an active and willing family, may become ten times more productive than it was before. The general commerce will be increased.
The treasure of the prince will accumulate.

The country will supply more soldiers. It is clear, therefore, that the system is beneficial to the prince. Poland would be thrice as populous and wealthy as it is at present if the peasants were not slaves.
Nor is the system less beneficial to the great landlords. If we suppose one of these to possess ten thousand acres of land cultivated by serfs, these ten thousand acres will produce him but a very scanty revenue, which will be frequently absorbed in repairs, and reduced to nothing by the irregularity and severity of the seasons. What will he in fact be, although his estates may be vastly more extensive than we have mentioned, if at the same time they are unproductive?
He will be merely the possessor of an immense solitude. He will never be really rich but in proportion as his vassals are so; Edition: current; Page: [ 7 ] his prosperity depends on theirs. If this prosperity advances so far as to render the land too populous; if land is wanting to employ the labor of so many industrious hands—as hands in the first instance were wanting to cultivate the land—then the superfluity of necessary laborers will flow off into cities and seaports, into manufactories and armies.
Population will have produced this decided benefit, and the possession of the lands by the real cultivators, under payment of a rent which enriches the landlords, will have been the cause of this increase of population.
There is another species of property not less beneficial; it is that which is freed from payment of rent altogether, and which is liable only to those general imposts which are levied by the sovereign for the support and benefit of the state.
It is this property which has contributed in a particular manner to the wealth of England, of France, and the free cities of Germany.By Abe Hawken For Mailonline. A boy raped and sexually abused his three younger siblings repeatedly in a home where they lived a 'feral' existence in conditions of 'utter deprivation', a court heard today.
Their mother totally neglected the four youngsters, who were left to fend for themselves in their filthy and squalid house in Gloucester, the court was told. The children lived without boundaries or rules and did not know the difference between right and wrong, said prosecutor Philip Warren. The eldest brother, now fourteen, admitted six offences against his two brothers, currently aged six and seven, and one sister who is now aged Their mother totally neglected the four youngsters, who were left to fend for themselves in their filthy and squalid house, Gloucester Crown Court pictured wast told.
He denied a final charge of inciting his sister to watch him and a brother engage in sexual activity and the prosecution did not proceed with that count. The offences all took place between December and May last year when the defendant was aged between 10 and thirteen, the court was told. Judge Jamie Tabor QC told the boy: 'It would appear that from about the age of eight you started sexually misbehaving with the three youngest members of your family.
Do you understand now that what you did was wrong? The tousle haired boy, now living with foster parents - who sat alongside him in court - replied 'Yes. The judge added: 'Had you been grown up you would have been sent to prison for a long, long time. Judge Tabor said the background to the offences was that the boy's father 'rarely visited the house and when he did he was pretty cross and nasty.
He added: 'Your mother did nothing to bring you up. She failed to provide even the most basic things and neglected you all very much. There was little to no supervision by any grown ups and no boundaries in place. No rules. Judge Jamie Tabor QC pictured told the youngster that if he was older he would be going to prison. The judge placed the boy under 18 months supervision with a 16 day programme requirement and 16 days activity requirement.
He also put the boy on the sex offender register for two and a half years and made a restraining order preventing the boy from seeing his siblings except under supervision. Mr Warren told the court: 'These children were living in conditions of what could be called abject squalor. It was unclear when the abuse had started but it appeared to be when the boy was about eight and below the age of criminal responsibility, said Mr Warren.
William Rose, defending, said 'This is a desperately sad case. We have young children who were effectively left to fend for themselves. They had to find food for themselves, bathe themselves, if they bathed at all, and had no set routine at bedtime and put themselves to bed. There is no issue there. Earlier this week, the defendant's 36 year old dad denied three charges of assaulting, ill treating, neglecting, abandoning or exposing the children to harm and was bailed to await trial on a date to be fixed.
He has to return to court on November 20 for trial arrangements to be finalised. Last month, the childrens' year-old mother admitted similar charges involving all four youngsters, dated between Sept and Mayand was bailed to await sentence at a date to be fixed after the father's trial has taken place.
